Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Banter website, web app, browser extension, desktop app, iOS app, AI integrations, and related services (collectively, the “Service”). By creating an account, connecting Banter to another service, or using the Service, you agree to these Terms.

1. Eligibility and Accounts

You must be at least 16 years old and legally able to agree to these Terms. You are responsible for the accuracy of your account information, for protecting your credentials and access tokens, and for activity performed through your account. Tell us promptly if you believe your account has been compromised.

2. Using Banter

Banter helps you capture, organize, search, and work with notes, recordings, transcripts, attachments, tasks, and related workspace content. You may use the Service only in compliance with applicable law, these Terms, and the rights of other people.

3. Your Content

You retain ownership of content you create or upload. You give Banter a limited, worldwide license to host, copy, process, transmit, and display that content only as needed to operate, secure, improve, and support the Service. This license ends when the content is deleted, subject to normal backup retention and legal obligations described in our Privacy Policy.

You represent that you have the rights and permissions needed to provide your content to Banter and to ask Banter or a connected service to process it.

4. Recordings and Consent

You are responsible for notifying participants and obtaining every consent required before recording, transcribing, or processing a conversation. Recording laws vary by location and may require consent from every participant. Banter does not provide notice or obtain consent on your behalf.

5. AI and Automated Features

Banter uses AI and transcription services to generate transcripts, summaries, search results, suggestions, speaker labels, and other outputs. These outputs can be incomplete, inaccurate, or unsuitable for your situation. Review important outputs before relying on them, especially for legal, medical, financial, employment, or other high-impact decisions.

6. Connected Services and AI Plugins

You may connect Banter to third-party AI clients and other services. Once connected, those services may read or change workspace content within the permissions you approve. You are responsible for requests made through a connected service and for reviewing its own terms and privacy practices. Disconnect or revoke a connection if you no longer trust or use it.

7. Acceptable Use

You may not use the Service to:

  • Break the law, violate another person’s rights, or record someone unlawfully.
  • Upload malware or attempt to disrupt, probe, or bypass the Service’s security.
  • Access another person’s account or content without authorization.
  • Abuse the Service in a way that materially degrades it for other users.
  • Use automated access outside the interfaces and limits Banter provides.
  • Misrepresent AI-generated content as verified fact when doing so could cause harm.

8. Banter’s Software and Brand

Banter and its licensors retain all rights in the Service, software, design, documentation, logos, and other materials that are not your content. These Terms give you a limited, non-exclusive, non-transferable right to use the Service while your account remains active. They do not grant you ownership of Banter’s intellectual property.

9. Paid Features

If you purchase a paid plan, the price, billing period, included usage, renewal terms, and cancellation options shown at purchase apply. Fees are non-refundable except where required by law or expressly stated otherwise. We may change future pricing or plan limits with reasonable notice; changes do not retroactively alter a billing period you have already paid for.

10. Third-Party Services

The Service relies on third-party hosting, authentication, transcription, AI, and distribution providers. Banter is not responsible for third-party services, their availability, or their independent handling of data outside Banter’s control. Your use of those services may be governed by separate terms.

11. Service Changes and Availability

We may add, change, suspend, or discontinue features. We work to keep Banter available and secure, but we do not guarantee uninterrupted or error-free operation. We may temporarily restrict access to protect users, investigate abuse, perform maintenance, or comply with law.

12. Suspension and Termination

You may stop using Banter at any time. We may suspend or terminate access if you materially violate these Terms, create a security risk, fail to pay applicable fees, or use the Service in a way that could harm Banter or others. Where practical, we will provide notice and an opportunity to resolve the issue.

13. Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available.” Banter disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from a course of dealing. These disclaimers do not limit rights that cannot legally be waived.

14. Limitation of Liability

To the fullest extent permitted by law, Banter will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunity arising from the Service. Banter’s total liability for claims relating to the Service will not exceed the amount you paid Banter during the 12 months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot legally be limited.

15. Changes to These Terms

We may update these Terms as the Service changes. Material changes will be announced through the Service or by email before they take effect. Continuing to use the Service after the effective date means you accept the updated Terms.
